Setting up an Enduring Power of Attorney
An Enduring Power of Attorney means that you (the Principal) give the power to another person or persons (your Attorneys) to make personal and/or financial decisions on your behalf.
The power to make financial decisions on your behalf may begin immediately or at an appointed time or circumstance, for example, it may start only if you lose capacity to make such decisions for yourself. The power to make health decisions on your behalf may only start when you do not have capacity to do so yourself.
An Enduring Power of Attorney is a very important document and careful consideration must be given to whom you appoint as an Attorney, any limitations on their power/s, and the timing of when the power is to commence. We are experienced in providing advice in this regard and drafting the required documents.
