Contesting a Will
There are various ways in which disputes related to estate administration may arise. For example:
- You or a family member may have been left out of a Will but believe in the circumstances you or the family member should have been included.
- The wording of the Will may be ambiguous or unclear leading to a disadvantage on your part.
- You may have been appointed the Executor or Trustee under the Will and that appointment is being challenged by another.
- You may believe the deceased did not have capacity to make the Will at the time the Will was executed.
- You may be a beneficiary under the will and the bequest to you is being challenged by another.
We are able to assist you with these types of disputes and others that may arise. We encourage a cost effective approach by means of alternative dispute resolution where this is possible. It is important to seek legal advice as soon as possible as time limits apply to many claims.
